11.3       Extension of the 2020/21 User Fees and Charges Schedule

Purpose of the Report

1.       This report seeks approval to continue use of the 2020/21 User Fees and Charges Schedule from 1 July 2021 to 1 August 2021 which will allow it to continue to be used until a new User Fees and Charges Schedule 2021/22 is adopted with the Long-term Plan by Council which will supersede it.

Recommendations

That the Council:

(a)     Adopts the recommendation to continue to use the User Fees and Charges Schedule 2020/21 from the period 1 July 2021 to 1 August 2021, which enables the current schedule to be used until the new schedule is adopted.

 

 

Discussion

2.       User fees and charges are updated by Council on an annual basis. Updates reflect changing circumstances, Consumer Price Index (CPI) adjustments, new or removed fee requirements, or benchmarking with other Councils. Some user fees and charges are set by government legislation. The user fees and charges must fairly reflect the cost of services available and offered by Council.

3.       At its meeting of 30 July 2020, Council adopted the user fees and charges for 2020/21. The Annual Plan 2020/21 was adopted late due to the impacts of COVID-19. The fees took immediate effect upon adoption.

4.       Due to the decision by Council on 8 February 2021 to extend the timeframe to allow for a late adoption of the 2021-31 Long-term Plan to the week beginning 26 July 2021. It has meant that for the period 1 July until the adoption of the Long-term plan that the User Fees and Charges Schedule 2020/21 remains in place till this date. 

5.       This report seeks to confirm that, for the avoidance of any doubt, the User Fees and Charges Schedule 2020/21 will remain in effect for the period 1 July 2021 to 1 August 2021.

6.       This is with the exception of the price for volumetric water as this is charged as a rate and so will be effective from 1 July 2021.

7.       At its meeting of 4 May, Council adopted the Statement of Proposal: draft User Fees and Charges and Statement of Proposal: draft Revenue and Finance Policy for consultation using a Special Consultative Procedure.

8.       Public consultation for the draft LTP was undertaken between 7 May and 7 June 2021.

9.       A deliberations report was presented to Council on 24-25 June to deliberate on the issues raised and feedback received throughout the consultation period and hearings on draft User Fees and Charges.

10.     In the report it addressed the general and specific comments on user fees and charges and no changes were recommended as a result of submissions.

11.     One change was recommended by staff to the fees for additional bins for Council’s new kerbside service. This recommendation was endorsed by Council.

12.     Given that the amendment is relatively minor in nature and that no changes were made as a result of any of the submissions on user fees and charges, staff are recommending that Council adopt the recommendation to continue to use the User Fees and Charges Schedule 2020/21 from the period 1 July 2021 to 1 August 2021, which enables the current schedule to continue to be used until the new schedule is adopted on 26 July.

Significance

13.     The Local Government Act 2002 requires an assessment of the significance of matters, issues, proposals and decisions in this report against Council’s Significance and Engagement Policy.  Council acknowledges that in some instances a matter, issue, proposal or decision may have a high degree of importance to individuals, groups, or agencies affected by the report.

14.     In making this assessment, consideration has been given to the likely impact, and likely consequences for:

(a)   the current and future social, economic, environmental, or cultural well-being of the district or region

(b)   any persons who are likely to be particularly affected by, or interested in, the decision, or matter

(c)   the capacity of the local authority to perform its role, and the financial and other costs of doing so.

15.     In accordance with the considerations above, criteria and thresholds in the policy, it is considered that the document referenced within this report is of medium significance.

ENGAGEMENT

16.     Taking into consideration the above assessment, that the document referenced within this report are of medium significance, officers are of the opinion that no further engagement is required prior to Council making a decision.

Next Steps

17.     User Fees and Charges Schedule 2021/22 document will be prepared, including the changes approved in the Long-term Plan deliberations, and will be presented to for adoption by Council on 26 July 2021 to be effective from 1 August 2021.
