Terms of reference – Policy Committee
Common responsibilities and delegations
The following common responsibilities and delegations apply to all standing committees.
Responsibilities of standing committees
· Establish priorities and guidance on programmes relevant to the Role and Scope of the committee.
· Provide guidance to staff on the development of investment options to inform the Long Term Plan and Annual Plans.
· Report to Council on matters of strategic importance.
· Recommend to Council investment priorities and lead Council considerations of relevant strategic and high significance decisions.
· Provide guidance to staff on levels of service relevant to the role and scope of the committee.
· Establish and participate in relevant task forces and working groups.
· Engage in dialogue with strategic partners, such as Smart Growth partners, to ensure alignment of objectives and implementation of agreed actions.
Delegations to standing committees
· To make recommendations to Council outside of the delegated responsibility as agreed by Council relevant to the role and scope of the Committee.
· To make all decisions necessary to fulfil the role and scope of the Committee subject to the delegations/limitations imposed.
· To develop and consider, receive submissions on and adopt strategies, policies and plans relevant to the role and scope of the committee, except where these may only be legally adopted by Council.
· To consider, consult on, hear and make determinations on relevant strategies, policies and bylaws (including adoption of drafts), making recommendations to Council on adoption, rescinding and modification, where these must be legally adopted by Council,
· To approve relevant submissions to central government, its agencies and other bodies beyond any specific delegation to any particular committee.
· To appoint a non-voting Tangata Whenua representative to the Committee.
· Engage external parties as required.

Role
· To establish, implement and review the operational policy and planning framework for decision making that will assist in achieving the strategic priorities and outcomes for the Tauranga City Council.
· To establish policies and plans for decision making that will assist in achieving the strategic priorities and outcomes.
Scope
· Manage the process of development of the Long Term Plan and Annual Plan, including the hearing of submissions, and determine the form and extent of public consultation methods to be employed. (Note: The Council cannot delegate to a Committee the adoption of the Long-term Plan and Annual Plan).
· Develop and review bylaws.
· Develop, review and approve policies and plans.
· Develop and approve the draft Statement of Intent for the Council’s Council-Controlled organisations (CCOs).
· Undertake any reviews of CCOs and make recommendations on any proposed changes to CCO governance arrangements.
· Consider and approve changes to service delivery arrangements arising from the service delivery reviews required under LGA 2002 that are referred to the Committee by the Chief Executive.
· Approve Council submissions to central government, councils and other organisations including submissions to any plan changes or policy statements.
Power to act
· To make all decisions necessary to fulfil the role and scope of the Committee subject to the limitations imposed.
· To establish subcommittees, working parties and forums as required.
· To appoint a non-voting Tangata Whenua representative to the Committee.
Power to recommend
· To Council and/or any standing committee as it deems appropriate.

Purpose of the Report
1. To receive and hear submissions from the public on the draft Annual Plan 2020/21.
That the Policy Committee: a) Receives the verbal and written submissions to the draft Annual Plan 2020/21.

Executive Summary
2. The COVID-19 pandemic has had a significant impact on Council’s planning for its 2020/21 Annual Plan. These impacts have been identified and better understood since the adoption of the original draft 2020/21 Annual Plan in March 2020.
3. The original draft Annual Plan consultation document noted that, before the final Annual Plan is considered and adopted, further work would be undertaken to understand the impact of COVID-19 and Council’s appropriate response in that document.
4. Public
consultation for the original draft Annual Plan 2020/21 was undertaken between
3 April and 3 May 2020. The consultation document presented five questions for
consideration.
(i) Which infrastructure investments are most important to you, and why?
(ii) What is your view on the proposed rates increase for 2020/21?
(iii) What is your view on reducing the Uniform Annual General Charge to 10%?
(iv) What is your view on the commercial differential increasing to 1:1.2?
(v) Is there anything else you would like to tell us about this annual plan?
5. On 28 May 2020, Council considered various options to address the current financial situation for 2020/21 in response to social, economic and financial disruption caused by the COVID-19 pandemic and to ensure Council is preparing for future years as it develops the Long-term Plan 2021-31. Council resolved to approve a draft 2020/21 capital programme of $244m and an associated total rate increase of 4.7% after growth.
6. At its meeting 16 June 2020 Council adopted a revised draft Annual Plan 2020/21 for public consultation.
7. Public
consultation for the revised draft Annual Plan 2020/21 was undertaken between
17 June and 1 July 2020. The consultation document presented five questions for
consideration.
(i) How strongly do you agree or disagree with an overall rates rise of 4.7%?
(ii) How strongly do you agree or disagree with the proposed changes to operational budget?
(iii) How strongly do you agree or disagree with the proposed list of capital projects for 2020/21?
(iv) Do you have any comments on: Fees and Charges; Revenue and Finance Policy and 2020/21 Development Contributions Policy?
(v) Do you have any other feedback on the contents of the annual plan?
8. This cover report is presented to Council to enable the hearing of submissions for both consultation periods.
9. An updated speakers’ schedule with page references will be provided at the hearing.
Background
10. On 24 March 2020, following work that started in the third quarter of 2019, Council adopted its original draft 2020/21 Annual Plan for the purposes of public consultation. That date was one day after the government announced the nation had moved into COVID-19 Alert Level 3 and two days before the Alert Level 4 lockdown commenced.
11. Consultation on the original draft annual plan commenced on 3 April and closed on 3 May. 291 submissions have been received from individuals and organisations. Hearings and deliberations on those submissions were put on hold while Council re-considered the contents of the draft Annual Plan and determined whether a further period of re-consultation is warranted.
12. Further work was undertaken by Council and at its meeting 16 June 2020 Council adopted a revised draft Annual Plan 2020/21 for public consultation from 17 June to 1 July 2020. To date, 336 submissions have been received from individuals and organisations.
Strategic / Statutory Context
13. The Local Government Act 2002 (LGA) requires local authorities to prepare and adopt an Annual Plan for each financial year. This report is in relation to the 2020/21 financial year, which is the third year of the LTP. Developing an Annual Plan requires consultation on changes that are significantly or materially different from the LTP.
Discussion
14. Consultation
on the original draft Annual Plan 2020/21 was undertaken from 3 April and
3 May 2020. 291 submissions were received, with 72 submitters requesting to
speak at hearings at the time of writing.
15. Consultation on the revised draft Annual Plan 2020/21 was undertaken from 17 June to 1 July 2020. 336 submissions were received, with 21 submitters requesting to speak at hearings at the time of writing.
(a) The hearings schedule can be found at Attachment 1. An updated speakers schedule with page references will be provided at the hearing.
(b) Attachments 2-8 provide all the written submissions to the draft Annual Plan 2020/21 at the time of writing. Copies of all submissions received after the time of writing will be provided at the hearing.
(c) Several submissions in Attachments 2-8 have been redacted due to offensive language and to remove the personal contact details of submitters.
Next Steps
16. Annual Plan 2020/21 deliberations are scheduled to take place during 15-17 July 2020.
