Terms of reference – Tangata Whenua/Tauranga City Council Committee
Common responsibilities and delegations
The following common responsibilities and delegations apply to all standing committees.
Responsibilities of standing committees
· Establish priorities and guidance on programmes relevant to the Role and Scope of the committee.
· Provide guidance to staff on the development of investment options to inform the Long Term Plan and Annual Plans.
· Report to Council on matters of strategic importance.
· Recommend to Council investment priorities and lead Council considerations of relevant strategic and high significance decisions.
· Provide guidance to staff on levels of service relevant to the role and scope of the committee.
· Establish and participate in relevant task forces and working groups.
· Engage in dialogue with strategic partners, such as Smart Growth partners, to ensure alignment of objectives and implementation of agreed actions.
· Confirmation of committee minutes.
Delegations to standing committees
· To make recommendations to Council outside of the delegated responsibility as agreed by Council relevant to the role and scope of the Committee.
· To make all decisions necessary to fulfil the role and scope of the Committee subject to the delegations/limitations imposed.
· To develop and consider, receive submissions on and adopt strategies, policies and plans relevant to the role and scope of the committee, except where these may only be legally adopted by Council.
· To consider, consult on, hear and make determinations on relevant strategies, policies and bylaws (including adoption of drafts), making recommendations to Council on adoption, rescinding and modification, where these must be legally adopted by Council.
· To approve relevant submissions to central government, its agencies and other bodies beyond any specific delegation to any particular committee.
· To appoint a non-voting Tangata Whenua representative to the Committee.
· Engage external parties as required.

Membership
Partners Tauranga City Council and "nga hapu me nga iwi o Tauranga Moana" representing Tangata Whenua within the Tauranga City Council rohe (boundaries).
Tangata Whenua representatives are to be those with signed hapu protocols. One of the six Tangata Whenua representatives is to be a Kaumatua. Kaumatua representation is to have the ability to be shared between two Kaumatua if required.
Background
Council is committed to establishing and monitoring appropriate links with Tangata Whenua to enable effective relationships to develop and meet a number of legislative requirements including those under the Resource Management Act 1991 and the Local Government Act.
1. Tangata Whenua are deemed to be the respective Iwi and Hapū of Tauranga Moana.
2. The Local Government Act 1974 and Local Government Act 2002 contain provisions relating to the exercise of the powers, functions and duties of the Tauranga City Council.
Principles of the partnership
The Partners:
· Recognise the Treaty of Waitangi as the founding document of Aotearoa NZ.
· Will work with respect, goodwill, honesty, trust and integrity toward the other party and celebrate cultural diversity.
· Recognise that the relationship is a mutual two-way relationship and any changes of the agreement need to involve discussions and agreement between the partners.
· Recognise the need for Tauranga City Council to work within a legislative framework.
· Recognise the independence of each partner, including:
(a) The tangata whenua representatives as a voice for the Māori communities;
(b) Recognise the independence of hapū and iwi;
(c) The Council as a democratic decision maker, responsible to the community as a whole.
Role and scope
· To forge an ongoing effective and meaningful partnership between the Tauranga City Council and Tangata Whenua.
· To facilitate meaningful understanding of future impacts on key issues affecting Tangata Whenua and Māori that Council can influence.
The functions and key tasks are:
(a) To bring to the other partner's attention issues / concerns in respect of existing strategy or policy.
(b) To exchange information of mutual interest.
(c) To discuss new initiatives approaches and directions.
(d) Agree agenda topics for the following three consecutive meetings.
Communication
· To educate the wider community on Tangata Whenua issues.
· To establish and maintain communication and consultation channels within the Council organisation and Tangata Whenua groups.
Monitoring
· To regularly monitor projects, policies and strategies managed or under development by Council which affect Tangata Whenua.
· To regularly monitor progress of key issues identified by Tangata Whenua through reporting of Council and the Tangata Whenua Collective (Te Rangapū Mana Whenua o Tauranga Moana).
· To monitor the on-going development and process of the Standing Committee.
Power to recommend
· To Council or any Standing Committee as it deems appropriate.
· Reports to Council.

Key points · On 21 June, the Battle of Te Ranga anniversary and remembrance service had taken place; it was heart-warming to note participation in the service had increased over the years from 11 people when it first started to approximately 200 people who braved the weather to attend. · The Chairperson acknowledged the hard-work, commitment, and support that had gone towards establishing Māori Wards. · The Commissioners mahi was recognised and acknowledged during the Long Term Plan (LTP) hearings held at Te Whetu marae. · Ms Matire Duncan’s resignation after over twenty years of service to Nga Potiki was recognised, particularly the creation and success of its commercial arm. · The décor in TCC Chambers may need to reflect the future co-governance arrangements once Māori wards were formalised. · It was important to have good Māori representation at the governance level for the benefit of all people who called Tauranga home.

Key points · The report was taken as read.
Discussion points raised · The 3 waters reforms were complex, multi-layered, and of significance to Tangata Whenua so the engagement kaupapa process was imperative in order to ensure that the community was kept updated, informed, and educated. · Boundary lines between the three territorial authorities were problematic and caused a myriad of ongoing issues. · The proactive partnership between Tauranga City Council (TCC) and Tangata Whenua was acknowledged, particularly after the installation of the Commission. · Cultural connections and cultural day events organised by the Te Pou Takawaenga team were praised; both sessions were incredibly useful and insightful for the Commission and was a great tool to educate newcomers to TCC. · The 3 Waters and Resource Management Act 1991 reforms and the Local Government Review did not have a sense of connectiveness to one another which could cause future issues. · It was equally worrisome that the community were not voicing concerns or providing feedback about the reforms or the review because these changes would have a large impact on communities and future generations to come. · SmartGrowth had been helpful in navigating difficult paths and its support was acknowledged. · The Strategy, Finance and Risk Committee (SFRC) meeting on 28 June 2021 would include a report on the 3 Waters reforms and another report on all other reforms. · It was important for Tangata Whenua to encourage territorial authorities to provide support and feedback during the reforms and speak with a unified voice.

Key points · The report was taken as read. · From 4-7 June 2021, the centenary commemoration of Tahupōtiki Wiremu Rātana was held at Tahuwhakatiki Marae and TCC’s $5000.00 grant from the Legacy Fund was acknowledged.
Discussion points raised · The approachability and openness by Commissioners to engage constructively on an equal platform with Tangata Whenua was strongly appreciated, especially on the LTP and other difficult conversations. · The Local Government 101 trainings, Māori wards workshop, and the representation review workshops had been beneficial for Tangata Whenua representatives. · Tangata Whenua were working on their next strategic plan and a wānanga would be held at Harini Marae. · The Rangapū website now provided Tangata Whenua a level of consistency in terms of communication and information dissemination. · The flexibility provided to Tangata Whenua at Te Whetu Marae to speak and engage with the Commissioners during the LTP hearings was acknowledged.

Key points · The Strategy, Finance and Risk Committee (SFRC) had discussed the representation review and feedback received from the Committee had been included in this presentation. · Staff had been instructed by SFRC to explore a fourth option in addition to the three options that were presented in the staff report. · The representation review process required the Council to identify communities of interest within Tauranga as the first step, determine how these could be effectively and fairly represented, and and consider the establishment (or not) of community boards. · The current representation arrangements comprised 10 councillors (four at large and six from within three wards); the Mayor was elected at large and there were no community boards. · A representation and electoral systems comparison of other metros was discussed. · Communities of interests were not defined in the legislation but could beidentified using three main criteria - perceptual, function and political. by a. · Representation reviews were undertaken every six years. · Around New Zealand, a further 32 councils had established Māori Wards since the change in the legislation earlier in the year and all were conducting representations reviews. · . · Establishment of community boards was optional but had to be considered under the legislation as part of the representation review process. · Population equity for wards (plus or minus 10% rule) was for compliance in terms of fair representation within general wards. Statistics New Zealand (Statistics NZ) provided the demographic statistics and data which would assist in identifying complying options · TCC’s current electoral system was single transferable vote (STV) and was considered most effective with representation models that had larger wards. · Māori wards could not be repealed through the representation review process; however, a name for the single Māori ward would be needed. · The Local Government Commission (LGC) considered and provided a final determination if any appeals, objections were received to the Council’s final proposal or the Council opted for a non-complying proposal. · The timeline was discussed; 16 July to 13 August 2021 would be the early engagement process with the community, with a formal consultation process taking place from August to December 2021 that would include submissions/hearings/deliberations/appeals and objections. · The options for representation review were discussed including their advantages and disadvantages as well as cost implications.
In response to questions · To vote in the Māori ward, a voter had to be enrolled on the Māori Electoral Roll (MER); however, to stand as a candidate in the Māori ward, being enrolled in the MER was not a requirement. · Those voters who identified as Māori but were enrolled in the general ward and not in the MER would not be able to vote in the Māori Ward. · Statistics NZ would provide the demographic calculations on both Māori Electoral Population and General Electoral Population for all options. · The formula in the Local Electoral Act 2001 provided for one Māori member and this meant there would be a single Māori ward in Tauranga that covered the whole city . · The position of Mayor was not up for review and all voters could vote for the Mayor · Māori could stand as candidates in any ward, either Māori or general ward, or at large.. · The provision of additional Māori councillors in the future would depend on both a proportional increase in the Māori population compared to the general population and an increase in the number of ward councillors. · A non-compliant option would need to go to the LGC for determination and should be avoided if possible..
Discussion points raised · Te Rangapū Mana Whenua o Tauranga members were not privy to the information discussed in the report; staff would engage with Te Rangapū Mana Whenua o Tauranga members to seek their feedback.

Key Points · Second meeting as independent Chairperson. Had sat in workshops and presentations of the Rangapū. Chair acknowledged the heavy workload of Te Rangapū and the kaupapa they carried. · Noted the amount of strategic issues that tangata whenua members needed to be across and iwi involvement at a governance level. · Important to ensure iwi and tangata whenua were connected up across the various strands of work and projects e.g. Three Waters. Noted tangata whenua generally were under resourced for the workload required and participation expected. · Noted changes in iwi governance and also changes at Mangatawa. · Noted Irene Walker stepping off the Standing Committee and welcomed Destiny Leaf as the new appointment. · Noted Mererina Murray finishing at TCC after 31 years, thanked for all her hard work and contributions over the years.

External Ngareta Timutimu, Ratahi Cross, Riri Ellis
Key points First presenter – Ngareta Timutimu · Kaupapa had always been the reo; mixed with whanau of Whareroa and Ngati Tapu as a child – this marae was not here then. · Concerned about the interests of Ngai Tukairangi. Noted Ngai Tukairangi marae relationships, did not hear any other hapū name associated with these marae. Regards Ngai Tukairangi as the guardians of this place. Mentioned in Archdeacon Brown’s journals; a number of Treaty signatories were Ngai Tukairangi. Ngai Tukairangi has mana right through to Mauao and over to Whareroa area. · Noted qualifications in both history and te reo.
Second presenter – Ratahi Cross · Noted Ngai Tukairangi whakapapa to Mataatua; and the journeys from and to Tauranga Moana as a result of battles; did not come to this area and conquer it, returned home after war. Was a returning home of the people not an itinerant iwi conquering. Had to re-establish in Tauranga Moana. · Noted impact on the iwi from battle at Te Papa and the invasion of the Hauraki people; large number of tipuna killed, iwi was decimated. · Ngai Tukairangi was the biggest employer in the Bay of Plenty through SEEKA Limited; second largest business in the Tauranga City Council area after the Port of Tauranga. Had orchards and horticultural interests from the Far North, through the Bay of Plenty and over to Gisborne and Hawkes Bay. Largest orchardists in Hastings. Income centred here in Tauranga City. Had built a strong enough financial base that could now concentrate on home – Tauranga Moana. · Would be opening own marae in Te Papa next year, in the central city. Ngai Tukairangi and Ngati Tapu would be back in Te Papa.
Third presenter – Riri Ellis · Outlined whakapapa. · Outlined the Ngai Tukairangi organisation structure, and the entity with the relationship with Council. · Ngai Tukairangi was forming a bigger entity to bring together all the various parts and groups of Ngai Tukairangi; this larger grouping would then engage with Council. · Considered Matapihi was often subject to the desires of the wider community, left as an afterthought. Perception that better to upset poor Māori rather than rich Pakeha. · Noted significance of Mauao to Ngai Tukairangi. Noted various areas and issues of interest to Ngai Tukairangi e.g. Whareroa industrial area, fuel park storage, Otamataha and Te Papa, Mauao recreational reserve. · Southern pipeline – noted the establishment of the joint management governance group. · Matapihi community/spatial plan – had not progressed, needed to be dedicated work put in. Need to protect from encroachment e.g. cycleways, public transport. Work with Council to utilise resources available – protect green rural space proactively. · Whareroa – emphasised the need to do something extraordinarily important in that area – change zone in priority area, identify a future commercial zone, no further consents granted. · Ngai Tukairangi – protective of remaining land left; keen to repatriate interests in areas such as Te Papa, Ōtūmoetai, Otamataha, Poripori. Wanted to reconnect with these areas in the frameworks established by Council. Concerned that a relationship with Council provided some sort of de facto mana to hapū. · Mount Spatial plan – not opposed as long as was of benefit to Ngai Tukairangi whanau and provided meaningful gains. Asked to be involved in all relevant spatial plans, emphasised need for a dedicated Matapihi plan. · Wanted to re-initiate discussions about projects that should be underway e.g. Mauao recreational reserve. Also re-engage with Council where specific agreements were in place for specific sites. · Better digital connectivity was a priority. · Noted need for resourcing for iwi/hapū to participate and engage on various issues/projects such as resource consent work. · Indicated there would be a closer relationship between Ngai Tukairangi business entities and the hapū.
Discussion points raised · Thanked for an excellent presentation. Good to be brought up to date. · Noted Mr Cross’s presence at recent Ngai te Rangi trust meeting. · There was a need to be thinking more strategically and long-term about those things that were important to iwi/hapū in terms of the various reform processes taking place e.g. Three Waters. Keep reminding Council of long-term aspirations. Noted the problems with resourcing for iwi to be able to be involved in strategic planning processes. Huge opportunities but challenge around how to participate. · Noted that as one of the biggest employers in Tauranga area, especially in horticulture, there needed to be careful collaboration by Council with Ngai Tukairangi in terms of Three Waters and resource management reform. · Noted support for the management and possible removal/relocation of the Whareroa industrial estate.

External Mr Puhirake Ihaka – Te Rangapū Mana Whenua o Tauranga Moana
Key points · Acknowledged Irene Walker for her mahi on the Standing Committee and her contribution to the Committee. Welcomed Destiny Leaf as the new Rangapū member. · Noted the support from the Commissioners and Te Pou Takawaenga to allow Rangapū members to take up representative roles on various committees. · Three Waters – had been a number of hui, noted that there were still some confusion around tangata whenua role and the relationship with government. · Noted upcoming hui for Takitimu and Mataatua waka. · Rangapū Charter had been completed.
Discussion points raised · Mokoera Te Amo would attend Tangata Whenua/Tauranga City Council hui as part of succession planning. · Discussion around how the iwi governance seats in the Three Waters governance entities should be allocated, proposed to be based on waka. Believed it should be two dedicated seats for Tauranga Moana. · Noted positions being developed to support the 30-yr catchment plan.

Key points · Noted various key points in the report and updated the committee on projects. · Provided executed copies of the Matapihi Southern Pipeline Memorandum of Understanding and noted the establishment of the Advisory Group. · To clarify, Tauranga City Council was developing spatial plans (required to do so) and tangata whenua were being invited early in the piece to contribute and participate in the development of these plans, cultural layer input sought early in the plan development. Some iwi/hapū were proactively developing their own cultural/spatial plans. · Whareroa community plan – noted the ongoing discussion (resourced by Bay of Plenty Regional Council and supported by Tauranga City Council) around how a ten-year exit programme could be facilitated. Invitation to Ngai Tukairangi always open to participate. Was largely led by Ngati Kuku. Work underway on establishment of an emergency exit for the Whareroa community via the airport. · Te Pou Takawaenga had a papakainga advisor to provide support to hapū and land block trustees. Support was also available from the council planning department to help with provision of information to assist with decision making e.g. planning rules, Geotech data. · Still working with Western Bay Of Plenty District Council on issues that crossed authority boundaries.
