Role

·         To ensure the effective and efficient governance of the City.

·         To enable leadership of the City including advocacy and facilitation on behalf of the community.

Scope

·         Oversee the work of all committees and subcommittees.

·         Exercise all non-delegable and non-delegated functions and powers of the Council.

·         The powers Council is legally prohibited from delegating include:

        Power to make a rate.

        Power to make a bylaw.

        Power to borrow money, or purchase or dispose of assets, other than in accordance with the long-term plan.

        Power to adopt a long-term plan, annual plan, or annual report

        Power to appoint a chief executive.

        Power to adopt policies required to be adopted and consulted on under the Local Government Act 2002 in association with the long-term plan or developed for the purpose of the local governance statement.

        All final decisions required to be made by resolution of the territorial authority/Council pursuant to relevant legislation (for example: the approval of the City Plan or City Plan changes as per section 34A Resource Management Act 1991).

·         Council has chosen not to delegate the following:

        Power to compulsorily acquire land under the Public Works Act 1981.

·         Make those decisions which are required by legislation to be made by resolution of the local authority.

·         Authorise all expenditure not delegated to officers, Committees or other subordinate decision-making bodies of Council.

·         Make appointments of members to the CCO Boards of Directors/Trustees and representatives of Council to external organisations.

·         Consider any matters referred from any of the Standing or Special Committees, Joint Committees, Chief Executive or General Managers.

Procedural matters

·         Delegation of Council powers to Council’s committees and other subordinate decision-making bodies.

·         Adoption of Standing Orders.

·         Receipt of Joint Committee minutes.

·         Approval of Special Orders.

·         Employment of Chief Executive.

·         Other Delegations of Council’s powers, duties and responsibilities.

Regulatory matters

Administration, monitoring and enforcement of all regulatory matters that have not otherwise been delegated or that are referred to Council for determination (by a committee, subordinate decision-making body, Chief Executive or relevant General Manager).

Purpose of the Report

1.       To receive and hear submissions from the public on the draft 2024-2034 Long-term Plan.

 

Recommendations

That the Council:

(a)     Receives the report “2024-2034 Long-Term Plan Hearings”.

(b)     Receives the written and verbal submissions to the draft 2024-2034 Long-term Plan.

 

 

Executive Summary

2.       At its meeting of 6 November 2023, Council adopted the consultation document and supporting documents for the proposed draft 2024-2034 Long-term Plan with the consultation period opening on 15 November 2023.

3.       At the same meeting Council adopted the Statement of Proposal for the Draft User Fees and Charges and the Statement of Proposal for the Draft Revenue and Finance Policy for consultation using the Special Consultative Procedure.

4.       Council also adopted the supporting documentation for the draft 2024-2034 Long-term Plan, including:

(a)     Draft Policies (including draft Revenue and Financing Policy)

(b)     Draft Groups and Activities

(c)     Draft Performance Measures

(d)     Draft Significant Forecasting Assumptions

(e)     Draft Underlying Financial Statements

(f)      Draft Financial Strategy

(g)     Draft Infrastructure Strategy

(h)     Draft User Fees and Charges

5.       Council had previously adopted the draft Statement of Proposal for the Development Contributions Policy 2024/25 for concurrent public consultation with the draft 2024-2034 Long-term Plan on 16 October 2023.

6.       Public consultation for the draft 2024-2034 Long-term Plan was undertaken between
15 November and 15 December 2023. The consultation document presented eleven parts for consideration:

          Part One: A message from the Commissioners

          Part Two: Our Direction

          Part Three: Our biggest challenge: Striking the right balance

          Part Four: Our Priorities

                   Community spaces and facilities

                   Growth in existing urban space

                   Revitalising the city centre

                   Transport network upgrades

                   Growth in the west (Tauriko)

                   Sustainability and resilience

          Part Five: Consultation Topics

                   1. Should we introduce a new industrial rating category?

                   2. Should we introduce new targeted rates?

                            2.1 Private pool inspections

         2.2 New Targeted Rates to fund Local Urban Infrastructure - West Bethlehem and Pyes Pā West

         2.3 New Targeted Rates to fund Urban Growth - Te Tumu growth area (Pāpāmoa and Wairākei)

                   3. Should we sell our City Centre Parking Buildings to help fund capital projects?

                   4. Should we commit to a Community Stadium at Tauranga Domain in this decade?

          Part Six: Other ideas for consideration

1. Should we provide more incentives for development to enable more people to live and work in the city centre?

          2. Should we explore SmartTrip variable road pricing to help reduce congestion and fund transport improvements?

Background

7.       A full set of the 2,201 submissions received for the 2024-2034 Long-term Plan are part of this Agenda.  The submissions are collated into 20 volumes (refer Attachment 1). The submissions and Hearings schedule are publicly available on the Tauranga City Council website at:

8.      A list of the order of speakers is also attached to this agenda (Attachment 2). This will be subject to change as speakers are confirmed and will be updated and tabled for the hearings.

 

 

Strategic / Statutory Context

9.       Council is required to have a Long-term Plan under s93 of the Local Government Act. As part of this, it is required to utilise the Special Consultative Procedure under s93 (5) of the Act.

Significance

10.     The Local Government Act 2002 requires an assessment of the significance of matters, issues, proposals and decisions in this report against Council’s Significance and Engagement Policy.  Council acknowledges that in some instances a matter, issue, proposal or decision may have a high degree of importance to individuals, groups, or agencies affected by the report.

11.     In making this assessment, consideration has been given to the likely impact, and likely consequences for:

(a)   the current and future social, economic, environmental, or cultural well-being of the district or region

(b)   any persons who are likely to be particularly affected by, or interested in, the issue, proposal or matter.

(c)   the capacity of the local authority to perform its role, and the financial and other costs of doing so.

12.     In accordance with the considerations above, criteria and thresholds in the policy, it is considered that the Long-term Plan is of high significance.

ENGAGEMENT

13.     Taking into consideration the above assessment, that the Long-term Plan is of high significance, officers are of the opinion that no further engagement is required prior to Council making a decision due to the special consultative procedure having just concluded.

Next Steps

14.     Deliberations are scheduled to take place for the 2024-2034 Long-term Plan over 4 March and 5 March 2024.

15.     Council is due to adopt the final 2024-2034 Long-term Plan on 22 April 2024.
